Terms of Service

These Terms of Service ("Terms") govern your use of Chronicle Builder (the "Service"), a writing and worldbuilding application provided by Ember Ink Studio ("Ember Ink Studio", "we", "us", or "our"). By creating an account or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Who you are contracting with
The Service is provided by Ember Ink Studio, trading as Chronicle Builder. When you purchase a paid plan, your order is processed by our reseller Paddle (see section 7). You confirm that you are at least the age of majority in your jurisdiction or, if signing up on behalf of an organization, that you have authority to bind that organization.
2. The Service
Chronicle Builder provides tools to draft manuscripts, organize worldbuilding entities, generate AI-assisted content, and export your work. Features available to you depend on your subscription tier. We may add, change, or remove features at any time.
3. Your account
You are responsible for keeping your login credentials confidential and for all activity under your account. You must provide accurate information and keep it up to date. Notify us promptly of any unauthorized use.
4. Acceptable use
You agree not to misuse the Service. In particular, you will not:
- use the Service for unlawful, fraudulent, deceptive, or abusive purposes;
- infringe the intellectual property, privacy, or other rights of any person;
- upload malware, attempt to probe, scan, or breach the Service, or scrape it at scale;
- resell, sublicense, or redistribute the Service or its outputs as a substitute service;
- reverse engineer, decompile, or circumvent any technical limits or access controls;
- send spam or unsolicited communications through any Service feature.
5. AI features
Chronicle Builder includes generative-AI features (the "World Assistant", Smart Import, manuscript analysis, custom AI workspaces, and similar tools).
- Your prompts and inputs. You are responsible for the prompts you submit and for having the rights to any text, files, or other content you input. Do not submit personal data about others without a lawful basis, and do not submit content you do not have the right to use.
- Outputs. AI outputs may be inaccurate, biased, or incomplete. You are responsible for reviewing, verifying, and deciding how to use outputs. The Service is not a substitute for professional advice (legal, medical, financial, or otherwise).
- Prohibited AI use. You will not use AI features to generate illegal content, child sexual abuse material, content that sexualizes minors, non-consensual sexual content, content that identifies real people in sexual or defamatory contexts, deepfakes intended to deceive, targeted harassment, hate speech inciting violence, malware, or content designed to jailbreak or extract system prompts of our models.
- IP and takedowns. As between you and us, you retain rights in the content you input and, to the extent permitted by law, in the outputs you generate. If you believe content on the Service infringes your rights, email support@chroniclebuilder.com with the work concerned and your contact details. We may remove content, filter outputs, suspend features, or terminate accounts of repeat infringers.
6. Your content
You retain ownership of the manuscripts, worldbuilding entries, notes, and other content you create in the Service ("Your Content"). You grant Ember Ink Studio a limited, worldwide, non-exclusive, royalty-free license to host, store, copy, transmit, and display Your Content solely to operate and provide the Service to you, including running it through AI providers when you trigger an AI feature.
7. Payment, subscriptions, and refunds
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Paddle's terms apply to your purchase: see Paddle's Buyer Terms for payment, billing, taxes, cancellation, and refund mechanics.
Subscriptions renew automatically at the end of each billing period until canceled. You can cancel at any time from your account; cancellation takes effect at the end of the current billing period. Refunds are handled in accordance with our Refund Policy.
8. Intellectual property
The Service, including its software, design, documentation, and branding, is owned by Ember Ink Studio and protected by intellectual property laws. Subject to these Terms and your subscription, we grant you a limited, non-exclusive, non-transferable right to use the Service. We reserve all rights not expressly granted.
9. Service availability
We aim to keep the Service available, but do not guarantee that it will be uninterrupted, timely, secure, or error-free. We may schedule maintenance, change features, or impose reasonable usage limits.
10. Suspension and termination
We may suspend or terminate your access if you materially breach these Terms, fail to pay amounts due, create a security or fraud risk, or repeatedly or seriously violate our policies. You may stop using the Service at any time. On termination, your right to use the Service ends. We will give you a reasonable window to export Your Content before deletion, except where prompt deletion is required.
11. Disclaimers
To the maximum extent permitted by law, the Service is provided "as is" and "as available". Ember Ink Studio disclaims all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
12. Limitation of liability
To the maximum extent permitted by law, Ember Ink Studio will not be liable for any indirect, incidental, consequential, special, or exemplary damages, or for loss of profits, revenue, data, goodwill, or business opportunity. Our aggregate liability arising out of or related to the Service is capped at the fees you paid us (via Paddle) for the Service in the twelve (12) months before the event giving rise to the claim. Nothing in these Terms excludes liability for fraud, death, or personal injury caused by negligence, or any other liability that cannot be excluded by law.
13. Indemnity
You will indemnify and hold Ember Ink Studio harmless from claims, damages, and reasonable costs arising from Your Content, your use of the Service, or your breach of these Terms.
14. Changes to the Service or these Terms
We may update these Terms from time to time. If we make material changes, we will notify you (for example, by email or an in-app notice) before they take effect. Continued use of the Service after the effective date constitutes acceptance.
15. Governing law and disputes
These Terms are governed by the laws of the jurisdiction in which Ember Ink Studio is established, without regard to conflict-of-laws rules. The courts of that jurisdiction will have exclusive jurisdiction over any dispute, except where mandatory consumer law gives you the right to bring a claim in your local courts.
16. Miscellaneous
You may not assign these Terms without our prior written consent. We may assign them in connection with a merger, acquisition, or sale of assets. If any provision is found unenforceable, the remaining provisions will continue in effect. Neither party is liable for delays caused by events beyond reasonable control.
